Terms of Service

BOP is a self-service diagnostic tool. You choose one recurring operating problem, answer ten questions, and receive a one-page insight containing a friction score, a primary pattern, findings, recommended next actions, and one thing to watch.

BOP is a starting point for reflection and action. It is not a full operational audit, it does not determine the root cause of a problem, and it is not legal, financial, tax, accounting, or other professional advice. You are responsible for the decisions you make for your business.

You must be at least 18 years old and provide accurate information to use BOP. You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission. One account is for one person; assessments and results are licensed to the account holder and may not be shared or resold.

Each assessment costs $29 (USD), charged once. There is no subscription and no recurring charge. Payment is processed by our payment provider on its hosted checkout page when you begin an assessment. Prices are shown before you pay, and any applicable taxes are added at checkout.

After payment is confirmed, the assessment becomes available in your account immediately.

Because your insight is generated and delivered as soon as your assessment is complete, purchases are generally non-refundable. If you were charged in error, or your insight was never delivered, contact us and we will look into it and make it right, including issuing a refund where appropriate.

You agree not to copy, scrape, resell, sublicense, or redistribute BOP or its content; not to reverse engineer or attempt to extract the scoring logic, question sets, or interpretation content; not to interfere with the operation or security of the service; and not to use BOP to break the law.

BOP, its questions, scoring model, interpretation content, and visual design are owned by Zenith by Design and protected by intellectual property law. When you purchase an assessment, you receive a personal, non-transferable license to view, print, and save your own insight for use within your business. You do not receive ownership of the underlying method or content.

BOP may link to the Zenith Business Clarity Assessment or other Zenith by Design services. Those services are governed by their own terms, and we are not responsible for third-party sites or their content.

We work to keep BOP available, but we do not guarantee uninterrupted access. We may update, improve, or retire parts of the service, including question sets and interpretation content, and we may update these terms. If we make a material change to these terms, we will post the updated version here with a new date.

BOP is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and any warranty that the insight will produce a particular business outcome. Results depend on your responses and on factors outside our control.

To the fullest extent permitted by law, Zenith by Design will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of BOP. Our total liability for any claim relating to BOP will not exceed the amount you paid for the assessment giving rise to the claim.

These terms are governed by the laws of the jurisdiction in which Zenith by Design is established, without regard to its conflict of law rules. Nothing in these terms limits any right you have under mandatory consumer protection law.
